For those of you who are wanting to make an IRS tax settlement on back taxes called an offer in compromise, the IRS has a new fresh start program or fresh start initiative that can get you on your way to settle your taxes with the Internal Revenue Service.
 

Offers in Compromise/IRS Settlements



The IRS is also expanding a new streamlined Offer in Compromise (OIC) program to cover a larger group of struggling taxpayers.
This streamlined OIC is being expanded to allow taxpayers with annual incomes up to $100,000 to participate.
In addition, taxpayers must have tax liability of less than $50,000, doubling the current limit of $25,000 or less.
OICs  ( Tax Settlement) are subject to acceptance based on legal requirements.
An offer-in-compromise is an agreement between a taxpayer and the IRS that settles the taxpayer’s tax liabilities for less than the full amount owed.
An offer will not be accepted if the IRS believes that the liability can be paid in full as a lump sum or through a payment agreement.   The Internal Revenue Service will look at the taxpayer’s assets with taxpayers income and all of the expenses related to the taxpayers lifestyle.
An offer in compromise on back taxes allows you to settle your tax debt for less than the full amount you owe. It may be a legitimate option if you can’t pay your full tax liability, or doing so creates a financial hardship.
IRS will consider your unique set of facts and circumstances. There are no two cases the same. IRS will review the following:
1.  Your ability to pay,
2. Your Income,
3. Your Expenses and,
4. Your Asset equity.
IRS can generally approve an offer in compromise when the amount offered represents the most we can expect to collect within a reasonable period of time.
The Offer in Compromise program on back taxes is not for everyone. You must meet the qualifications for an offer in compromise or an IRS tax debt settlement.
IRS accepts 25% of all OIC.

a. Before the IRS can consider your offer, you must be current with all filing and payment requirements.
b. You are not eligible if you are in an open bankruptcy proceeding.

Forms you will need

 
a. Form 433-A (OIC) (individuals) or 433-B (OIC) (businesses) and all required documentation as specified on the forms;
b. Form 656(s) – individual and business tax debt (Corporation/ LLC/ Partnership) must be submitted on separate Form 656;
 

Application Fee

$150 application fee (non-refundable); and
Initial payment (non-refundable) for each Form 656.
