When the IRS denies taxpayers the opportunity to have an Offer in Compromise (OIC) , then those taxpayers can use this form. The taxpayer, by filing Form 13711, states that he or she wants the IRS to reevaluate his or her situation.
Tips:
- Before you want your appeal heard, you should check with a tax professional to see if the IRS’ reasons were sufficient to reject your offer. I have worked hundreds of these cases and the vast majority of times, your appeal has very little chance of getting accepted. The majority of time, the appeals officer will concur with the Agent reviewer of the Offer group.
- You want to consider asking the appeals agent to see if he or she can modify the offer or work with you to get it accepted for you and the IRS.
- Make sure the offer is timely. If you file the appeal late, you will be denied.
- Find out why the offer was rejected and make changes to the offer for the appeals agent. Ask the appeals agent how this can work.
- Hire a former IRS agent to review the whole package to see if another offer should be filed.
