What is a Tax Levy, Bank, Wage Tax Levy

A levy is a legal seizure of your property to satisfy a tax debt.
Levies are different from liens.
A lien is a claim used as security for the tax debt, while a levy actually takes the property to satisfy the tax debt.
If you do not pay your taxes  the IRS may seize and sell any type of real or personal property that you own or have an interest in.
For instance,
IRS could seize and sell property that you hold (such as your car, boat, or house), or
RS could levy property that is yours but is held by someone else (such as your wages, retirement accounts, dividends, bank accounts, licenses, rental income, accounts receivables, the cash loan value of your life insurance, or commissions).

IRS usually levy only after these three requirements are met:

  • IRS assessed the tax and sent you a Notice and Demand for Payment;
  • You neglected or refused to pay the tax; and
  • IRS sent you a Final Notice of Intent to Levy and Notice of Your Right to A Hearing (levy notice) at least 30 days before the levy. We may give you this notice in person, leave it at your home or your usual place of business, or send it to your last known address by certified or registered mail, return receipt requested. Please note: if we levy your state tax refund, you may receive a Notice of Levy on Your State Tax Refund, Notice of Your Right to Hearing after the levy.

If Fresh Start Tax LLC  determine the levy is creating an immediate economic hardship, the levy will be released ASAP.
A levy release does not mean you are exempt from paying the balance.
The IRS will work with you to establish payment plans or take other steps to help you pay off the balance.

Employers

Employers generally have at least one full pay period after receiving a Form 668-W, Notice of Levy on Wages, Salary and Other Income before they are required to send any funds from their employee’s wages.
Employers should encourage your employees that have a levy placed on their wages to contact the IRS as soon as possible to discuss a release of levy and resolution of their tax liability.
You may ask an IRS manager to review your case, or you may request a Collection Due Process hearing with the Office of Appeals by filing a request for a Collection Due Process hearing with the IRS office listed on your notice.
You must file your request within 30 days of the date on your notice.
Contact us today to get a release or remove your IRS tax Levy. We are professional Christian firm that has been practicing IRS tax  resolution since 1982 and we are the affordable Christian tax firm.

If you are a truck driver and are having IRS problems contact us  and we will  review your situation and  tax problem and give you the best possible remedies to go ahead and permanently fix the IRS tax problem that you are having at this time.
As Former IRS Agents we know all the tax options.
Many times because truck drivers are on the road  and not attentive to IRS notices and letters. With your frequency on road time, these  IRS Bills and IRS notices are never received.
When these IRS notices and letters go unresolved, the IRS must systematically issue a notice of tax levy. Many times those IRS tax levies are in the form of either a bank levy and or a garnishment of wages.

What is a Tax Levy

A levy is a legal seizure of your property to satisfy a tax debt. Levies are different from liens.
A lien is a claim used as security for the tax debt, while a levy actually takes the property to satisfy the tax debt.
If you do not pay your taxes (or make arrangements to settle your debt), the IRS may seize and sell any type of real or personal property that you own or have an interest in.

IRS may give you this notice in person, leave it at your home or your usual place of business, or send it to your last known address by certified or registered mail, return receipt requested.
The majority of time taxpayers  ( trucker drivers ) who have IRS problems and receive a IRS tax levy, 33% of the time have unfiled back tax returns that need to be brought up to date. IRS will generally not work with taxpayers who have unfiled tax returns.
Another problem for truck drivers is the fact that they are self-employed and responsible for making estimate tax payments.
Due to the cash flow and the high demands of bills and especially fuel cost, trucker drivers find it  almost  impossible to make estimate tax payments.
Just know it is in your best interest to attempt to make estimated tax payments so these problems stop reoccurring.
As a self-employed person, you are responsible for calculating your social security, matching it and then add to this an income tax amount. This is a killer!
The amount of total social security including Medicare is about 15% of what your net income is for that period plus the income tax that you should pay based on your tax bracket.
Many truck drivers have expenses to deduct.
You can deduct things like:
1. lease of the truck,
2. the insurance on the truck,
3. the fuel,
4. the repairs,
5. tolls.
6. licenses
You can also deduct for the depreciation of their truck. If they are interstate drivers and they spend the nights away from home they can deduct the travel expenses. They can also be allowed for meal expenses while on the road.
We at fresh start tax llc  have very specific forms used for truck drivers to make sure they take every single tax deduction they are legally entitled to make sure they to  the lowest amount of tax allowed by law.
Also if you are undergoing an IRS tax audit we can go ahead and defend that audit.
We have represented thousands of taxpayer since 1982.
No matter what you owe we can handle any IRS situation or tax problem you have.
Do not be bullied by the IRS.
With the new IRS fresh start initiative or fresh start program  there are many new options available to truck drivers than ever before.
Contact us today and you will speak directly to a tax attorney, certified public accountant, or a former IRS agent.

Note- if the IRS sends a levy your state tax refund, you may receive a Notice of Levy on Your State Tax Refund, Notice of Your Right to Hearing after the levy.

Legal- Method of Delivery

Federal Tax Regulation 301.6331-1(c) authorizes the IRS to provide depositories notices of levy by mail. However, the regulation does not preclude in-person delivery of a levy to a local branch or office by a revenue officer. Additionally, depositories may not designate a specific branch or location for service of hand-delivered levies.

No matter how a levy is received, by mail or hand delivered, depositories are expected to adhere to IRS guidelines by immediately processing the levy and freezing all affected accounts for the 21-day period required by Internal Revenue Code Section 6332(c).

A mailed levy becomes effective the date and time the notice of levy is delivered to the depository. A hand-delivered levy becomes effective the date and time the notice of levy is hand delivered in person by a revenue officer.

Tax Tips Combat Zones.

It is important to understand combat zone in term of IRS.

What geographic areas are considered combat zones?

Combat zones are designated by an Executive Order from the President as areas in which the U.S. Armed Forces are engaging or have engaged in combat.

There are currently three such combat zones (including the airspace above each):

Arabian Peninsula Areas, beginning Jan. 17, 1991 — the Persian Gulf, Red Sea, Gulf of Oman, the part of the Arabian Sea north of 10° North latitude and west of 68° East longitude, the Gulf of Aden, and the countries of Bahrain, Iraq, Kuwait, Oman, Qatar, Saudi Arabia and the United Arab Emirates.

Kosovo area, beginning Mar. 24, 1999 — Federal Republic of Yugoslavia (Serbia and Montenegro), Albania, the Adriatic Sea and the Ionian Sea north of the 39th Parallel.

Afghanistan, beginning Sept. 19, 2001.

Public Law 104-117 designates three parts of the former Yugoslavia as a Qualified Hazardous Duty Area, to be treated as if it were a combat zone, beginning Nov. 21, 1995 — Bosnia and Herzegovina, Croatia, and Macedonia.

In addition, the Department of Defense has certified these locations for combat zone tax benefits due to their direct support of military operations, beginning on the listed dates:

In support of Operation Enduring Freedom (Afghanistan combat zone):

Pakistan, Tajikistan and Jordan – Sept. 19, 2001
Incirlik Air Base, Turkey – Sept. 21, 2001 through Dec. 31, 2005
Kyrgyzstan and Uzbekistan – Oct. 1, 2001
Philippines (only troops with orders referencing Operation Enduring Freedom) – Jan. 9, 2002
Yemen – Apr. 10, 2002
Djibouti – July 1, 2002
Israel – Jan. 1 through July 31, 2003
Somalia – Jan. 1, 2004

In support of Operation Iraqi Freedom (Arabian Peninsula Areas combat zone):

Turkey – Jan. 1, 2003 through Dec. 31, 2005
the Mediterranean Sea east of 30° East longitude – Mar. 19 through July 31, 2003
Jordan – Mar. 19, 2003
Egypt – Mar. 19 through Apr. 20, 2003

These combat zones are ever changing.
