This blog deals with the Collection Process from the Florida Sales Tax

 
 
The Department of Revenue begins the collection process when a taxpayer fails to file a return, fails to make a payment, underpays the amount due, files late, pays late, or owes additional money that was discovered in an audit.
A delinquency notice (Notice of Delinquency) is issued when a return is not filed and a bill (Notice of Amount Due) is issued when a return is filed late or additional money is due.
The delinquency notice issued to a taxpayer indicates a return has not been filed, while the initial bill contains a breakdown of the additional amount due.
It is extremely important to take prompt action for resolution when you receive a billing or delinquency notice. If you cannot pay the tax in full is your best interest to call a tax professional to help resolve this matter to keep your business active in good standing with the Florida sales tax division.
 
 

Penalties and Interest

 

Penalties and interest continue to accumulate until the entire amount of the tax is paid. If the debt remains unpaid for 90 days, the Department will charge a 10% administrative collection processing fee to cover the costs of collecting the debt. There are avenues in which you can abate penalties and interest and you should call and speak to us about your particular case and see how we can help.
Failure to resolve your debt may result in your account being sent to a private collection agency. If your account is sent to a private collection agency and the debt includes reemployment tax (formerly known as unemployment tax), you will be charged a separate fee by the collection agency.

If a delinquency notice is received, it is important to file the missing return(s) and pay the tax as soon as possible. If a taxpayer is already enrolled for e-file and pay, they need to submit the missing returns and payments as they normally would.
If not currently on e-file, enrollment for e-Services is easy. A user ID and Password will be sent within 48 hours and then the taxpayer can electronically file and electronically pay past-due returns.

How the new IRS Fresh Start Program may help you.

 
In its latest effort to help struggling taxpayers, the Internal Revenue Service announced a series of new steps to help people get a fresh start with their tax liabilities.
The goal is to help individuals and small businesses meet their tax obligations, without adding unnecessary burden to taxpayers.
Specifically the IRS is announcing new policies and programs to help taxpayers pay back taxes and avoid tax liens.
 
The changes include:
1.Significantly increasing the dollar threshold when liens are generally issued, resulting in fewer tax liens,
2. Making it easier for taxpayers to obtain lien withdrawals after paying a tax bill,
3. Withdrawing liens in most cases where a taxpayer enters into a Direct Debit Installment Agreement,
4. Creating easier access to Installment Agreements for more struggling small businesses,
5. Expanding a streamlined Offer in Compromise program to cover more taxpayers.
 
Tax Lien Thresholds
 
The IRS will significantly increase the dollar thresholds when liens are generally filed. The new dollar amount is in keeping with inflationary changes since the number was last revised. Currently liens are automatically filed at certain dollar levels for people with past-due balances.
The IRS plans to review the results and impact of the lien threshold change in about a year.
A federal tax lien gives the IRS a legal claim to a taxpayer’s property for the amount of an unpaid tax debt. Filing a Notice of Federal Tax Lien is necessary to establish priority rights against certain other creditors.
Usually the government is not the only creditor to whom the taxpayer owes money.
A federal tax lien informs the public that the U.S. government has a claim against all property, and any rights to property, of the taxpayer. This includes property owned at the time the notice of lien is filed and any acquired thereafter.
A lien can affect a taxpayer’s credit rating, so it is critical to arrange the payment of taxes as quickly as possible.
 
Tax Lien Withdrawals
 
The IRS will also modify procedures that will make it easier for taxpayers to obtain a federal tax lien withdrawal.
Liens will now be withdrawn once full payment of taxes is made if the taxpayer requests it. The IRS has determined that this approach is in the best interest of the government.
In order to speed the withdrawal process, the IRS will also streamline its internal procedures to allow collection personnel to withdraw the liens.
 
Direct Debit Installment Agreements and Liens
 
The IRS is making other fundamental changes to liens in cases where taxpayers enter into a Direct Debit Installment Agreement.
For taxpayers with unpaid assessments of $25,000 or less, the IRS will now allow lien withdrawals under several scenarios:
Lien withdrawals for taxpayers entering into a Direct Debit Installment Agreement.
The IRS will withdraw a lien if a taxpayer on a regular Installment Agreement converts to a Direct Debit Installment Agreement.
The IRS will also withdraw liens on existing Direct Debit Installment agreements upon taxpayer request.
Liens will be withdrawn after a probationary period demonstrating that direct debit payments will be honored.  This period is three months.
In additions lowers user fees and saves the government money from mailing monthly payment notices.
 
Installment Agreements and Small Businesses
 
The IRS will also make streamlined Installment Agreements available to more small businesses. The payment program will raise the dollar limit to allow additional small businesses to participate.
Small businesses with $25,000 or less in unpaid tax can participate. Currently, only small businesses with under $10,000 in liabilities can participate.
Small businesses will have 24 months to pay.
The streamlined Installment Agreements will be available for small businesses that file either as an individual or as a business.
Small businesses with an unpaid assessment balance greater than $25,000 would qualify for the streamlined Installment Agreement if they pay down the balance to $25,000 or less.
Small businesses will need to enroll in a Direct Debit Installment Agreement to participate.
 
Offers in Compromise or Tax Debt Settlements

 
The IRS is also expanding a new streamlined Offer in Compromise (OIC) program to cover a larger group of struggling taxpayers.
This streamlined OIC is being expanded to allow taxpayers with annual incomes up to $100,000 to participate. In addition, participants must have tax liability of less than $50,000, doubling the current limit of $25,000 or less.
OICs are subject to acceptance based on legal requirements. An offer-in-compromise is an agreement between a taxpayer and the IRS that settles the taxpayer’s tax liabilities for less than the full amount owed.
Generally an offer or tax debt settlement will not be accepted if the IRS believes that the liability can be paid in full as a lump sum or through a payment agreement.
The IRS looks at the taxpayer’s income and assets to make a determination regarding the taxpayer’s ability to pay.

An offer in compromise allows you to settle your tax debt for less than the full amount you owe. It may be a legitimate option if you can’t pay your full tax liability, or doing so creates a financial hardship. the internal Revenue Service will consider your unique set of facts and circumstances.

c. Expenses; and
d. Asset equity.
IRS will generally approve an offer in compromise when the amount offered represents the most we can expect to collect within a reasonable period of time.

Forms necessary to file an offer in compromise
1. Form 433-A (OIC) (individuals) or 433-B (OIC) (businesses) and all required documentation as specified on the forms;
2. Form 656(s) – individual and business tax debt (Corporation/ LLC/ Partnership) must be submitted on separate Form 656;
 
The cost for filing an offer in compromise
$150 application fee (non-refundable); and
Initial payment (non-refundable) for each Form 656.
 
 Payment options
Your initial payment will vary based on your offer and the payment option you choose:
Lump Sum Cash Payment.
Submit an initial payment of 20 percent of the total offer amount with your application. Wait for written acceptance, then pay the remaining balance of the offer in five or fewer payments.
Periodic Payment:.
Submit your initial payment with your application.
You must continue to pay the remaining balance in monthly installments while the IRS considers your offer. If accepted, continue to pay monthly until it is paid in full.
 
Low income certification guidelines
If you meet the Low Income Certification guidelines, you do not have to send the application fee or the initial payment and you will not need to make monthly installments during the evaluation of your offer.
Understand the offer in compromise process
While your offer is being evaluated  you must be aware that:
1. Your non-refundable payments and fees will be applied to the tax liability (you may designate payments to a specific tax year and tax debt);
2. A Notice of Federal Tax Lien may be filed;
3. Other collection activities are suspended;
4. The legal assessment and collection period is extended;
5. You must make all required payments associated with your offer;
6. You are not required to make payments on an existing installment agreement; and
7.Your offer is automatically accepted if the IRS does not make a determination within two years of the IRS receipt date.
