The Legal Authority for a IRS tax seizure:

Notice and Demand must be given.

The IRS must give the taxpayer a notice stating the amount of the tax liability and demanding payment of it as soon as practicable, but within 60 days after assessment of the tax. IRC § 6303(a).

Notice and demand of the assessed tax is necessary prior to levy under IRC § 6331(a), and is also a prerequisite to the creation of the federal tax lien under IRC § 6321.

However, pursuant to Treas. Reg. § 301.6303-1(a), the failure to give notice within 60 days does not invalidate the notice.

Therefore, a late notice and demand given more than 60 days after assessment is a valid notice and demand for purposes of levy under IRC § 6331(a) and the creation of the federal tax lien under IRC § 6321.

An immediate payment of the tax is normally not demanded unless delay would jeopardize collection. Bremson v. United States, 459 F. Supp. 128 (W.D. Mo. 1978).

Notice and demand for immediate payment also should be made when the taxpayer’s taxable period is terminated pursuant to IRC § 6851 before the expiration of the taxable period.

Notice and demand need not personally be served upon the taxpayer to validate such notice.

The notice and demand must be left at the dwelling or usual place of business of the taxpayer or mailed to his/her last known address. If doubt exists as to the dwelling, place of business or last known address, the notice should be delivered or mailed to all of the available addresses.

Payment of only a portion of the tax after notice and demand represents neglect or refusal to pay. United States v. Wintner, 200 F. Supp. 157 (N.D. Ohio 1961), aff’d per curiam, 312 F.2d 749 (6th Cir. 1963), rev’d on other grounds, 375 U.S. 393 (1964).

A levy made before the expiration of the 10-day period after notice and demand, as well as a levy made before notice and demand, is invalid. L.O.C. Indus. Inc. v. United States, 423 F. Supp. 265 (M.D. Tenn. 1976).

A levy for a tax liability for which notice and demand was not made is invalid. Notification of a proposed assessment does not eliminate the need for notice and demand for payment of the tax once the assessment is made.

The IRS may accept an Offer in Compromise based on three grounds:

1. Doubt as to Collectibility.

 Doubt exists that the taxpayer could ever pay the full amount of tax liability owed within the remainder of the statutory period for collection.

2. Doubt as to Liability.

A legitimate doubt exists that the assessed tax liability is correct. Possible reasons to submit a doubt as to liability offer include:

  1. the examiner made a mistake interpreting the law,

  2. the examiner failed to consider the taxpayer’s evidence or

  3. the taxpayer has new evidence.

3. Effective Tax Administration –  Exceptional Circumstances

 

IRS Economic Hardship

When a taxpayers liability can be collected in full but collection would create an economic hardship, an ETA offer based on economic hardship can be considered.

The definition of economic hardship as it applies to ETA offers is derived from Treasury Regulations § 301.6343-1.

IRS Economic hardship occurs when a taxpayer is unable to pay reasonable basic living expenses.

The determination of a reasonable amount for basic living expenses will be made by the Commissioner and will vary according to the unique circumstances of the individual taxpayer.

Unique circumstances, however, do not include the maintenance of an affluent or luxurious standard of living.
Note:

Because economic hardship is defined as the inability to meet reasonable basic living expenses, it applies only to individuals (including sole proprietorship entities). Compromise on economic hardship grounds is not available to corporations, partnerships, or other non-individual entities.

The taxpayers financial information and special circumstances must be examined to determine if they qualify for an ETA offer based on economic hardship.

An IRS financial analysis includes reviewing basic living expenses as well as other considerations.

The taxpayers income and basic living expenses must be considered to determine if the claim for economic hardship should be accepted. IRS have certain applied standards that it will use.

Basic living expenses are those expenses that provide for health, welfare, and production of income of the taxpayer and the taxpayer’s family.

National and local standard expense amounts are designed to provide accuracy and consistency in determining taxpayer’s basic living expenses.You can find those on our website.

These standards are guidelines and if it is determined that a standard amount is inadequate to provide for a specific taxpayer’s basic living expenses, allow a deviation. Require the taxpayer to provide reasonable substantiation and document the case file.

 

In addition to the basic living expenses, other factors the IRS will to consider that impact upon the taxpayers financial condition include:

1. The taxpayers age and employment status,

2.Number, age, medical issues and health of the taxpayers dependents,

3.Cost of living in the area the taxpayer resides and

Any extraordinary circumstances such as special education expenses, a medical catastrophe, or natural disaster.

IRS Examination Methods

An IRS tax audit examination may be conducted by mail or through an in-person interview and review of the taxpayer’s records.

The IRS interview may be at an IRS office or at the taxpayer’s home, place of business, or accountant’s office (field audit).

Taxpayers may make audio recordings of interviews, provided they give the IRS advance notice. If the time, place, or method that the IRS schedules is not convenient, the taxpayer may request a change, including a change to another IRS office if the taxpayer has moved or business records are there.

The IRS audit notification letter tells which records will be needed. Taxpayers may act on their own behalf or have someone represent or accompany them. If the taxpayer is not present, the representative must have proper written authorization. The auditor will explain the reason for any proposed changes. Your Appeal Rights with the Internal Revenue Service.

Your appeal rights are explained by the examiner at the beginning of each audit. Taxpayers or Business Owners who do not agree with the proposed changes may appeal by having a supervisory conference with the examiner’s manager or appeal their case administratively within the IRS, to the U.S. Tax Court, U.S. Claims Court or the local U.S. District Court.

If there is no agreement at the closing conference with the examiner or the examiner’s manager, the taxpayer has 30 days to consider the proposed adjustments and their next course of action.

If the taxpayer does not respond within 30 days, the IRS issues a statutory notice of deficiency, which gives the taxpayer 90 days to file a petition to the Tax Court.

The Claims Court and District Court generally do not hear tax cases until after the tax is paid and administrative refund claims have been denied by the IRS.

 

The tax does not have to be paid to appeal within the IRS or to the Tax Court.

A case may be further appealed to the U.S. Court of Appeals or to the Supreme Court, if those courts accept the case.

Audit Selection Process

Selecting a return for audit does not always suggest that an error has been made. Returns are selected using a variety of methods, including:

1. Random selection and computer screening. Many  sometimes returns are selected based solely on a statistical formula.
2. Document matching.  When payor records, such as Forms W-2 or Form 1099, don’t match the information reported.
3. Related examinations.Tax returns may be selected for audit when they involve issues or transactions with other taxpayers, such as business partners or investors, whose returns were selected for audit.
