Need to file an Amended Return
If you discover an error after your return has been mailed, you may need to amend your return.
The IRS service center may correct errors in math on a return and may accept returns with certain forms or schedules left out. In these instances, do not amend your return! However, do file an amended return if your filing status, your income, your deductions or credits were incorrect.
Use Form 1040X (PDF), Amended U.S. Individual Income Tax Return, to correct a previously filed Form 1040 (PDF), Form 1040A (PDF), Form 1040EZ (PDF), Form 1040NR (PDF), or Form 1040NR-EZ (PDF). ImIf you are filing to claim an additional refund, wait until you have received your original refund (you may cash that check). To avoid penalty and interest, if you owe additional tax for a tax year, file Form 1040X and pay the tax by April 15 of the following year. If the due date falls on a Saturday, Sunday, or legal holiday, the due date is delayed until the next business day. The Form 1040X Instructions list the addresses for the service centers. File a separate Form 1040X for each year you are amending. Mail each form in a separate envelope. Be sure to indicate the year of the return you are amending on the front of Form 1040X.
The Form 1040X has been redesigned for tax year 2009. Previously the form consisted of three columns; Column A-Original amount, Column B-Net change, and Column C-Correct amount. The redesigned form now has just one column where the Correct Amount is the only figure entered, making it easier to make changes to previously filed returns. There is an area on the front of the form to explain why you are filing Form 1040X. Generally, to claim a refund, Form 1040X must be filed within 3 years from the date of your original return or within 2 years from the date you paid the tax, whichever is later.
Returns filed before the due date (without regard to extensions) are considered filed on the due date.

Fresh Start Tax Tip: Need a copy of your tax return? Here is how to do it!
If you need an exact copy of a previously filed and processed tax return and all attachments (including Form W-2), you can complete Form 4506 (PDF), Request for Copy of Tax Return, and mail it to the address listed in the instructions, along with a $57.00 fee for each tax year requested.
The check or money order for the fee should be made payable to the “United States Treasury.” Copies are generally available for returns filed in the current and past six years. Copies of jointly filed tax returns may be requested by either spouse and only one signature is required. Allow 60 calendar days to receive your copies. Most times you will get your information within 30 days, depending on the IRS work-load. Most needs for tax return information can be met with a computer print-out of your return information called a “transcript.” A transcript may be an acceptable substitute for an exact copy of a return by the United States Citizenship and Immigration Services and lending agencies for student loans and mortgages. A “tax return transcript” will show most line items contained on the return as it was originally filed.
If you need a statement of your tax account which shows changes that you or the IRS made after the original return was filed, however, you must request a “tax account transcript.” Both transcripts are generally available for the current and past three years and are provided free of charge. The period in which you will receive the transcript varies from within ten to thirty business days from the time the IRS receives your request for the tax return or tax account transcript. You can obtain a free transcript by calling 800-829-1040 and following the prompts in the recorded message or by completing and mailing a request for a transcript to the address listed in the instructions.
The IRS has createded a new Form 4506T-EZ, Short Form Request for Individual Tax Return Transcript, to order a transcript of a Form 1040 series return. The IRS created this streamlined form to help those taxpayers trying to obtain, modify or refinance a home mortgage. Transcripts may also be mailed to a third party, such as a mortgage institution, if specified on the form. You must sign and date the form giving your consent for the disclosure. Businesses, partnerships or individuals who need transcript information from other forms, such as Form W-2 or Form 1099, can use Form 4506-T (PDF), Request for Transcript of Tax Return, to obtain the information. These transcripts may also be mailed to a third party if there is consent for the disclosure.
Forms can be ordered by calling 800-829-3676.
If you are a taxpayer impacted by a federally declared disaster, the IRS will waive the usual fees and expedite requests for copies of tax returns for people who need them to apply for benefits or to file amended returns claiming disaster-related losses. For additional information, refer to Topic 107, Tax Relief Disaster Situations, or call the IRS Disaster Assistance Hotline at 866-562-5227.

There are many programs that the IRS has to settle tax debt. These federal tax relief programs are called Offers in Compromise. As former IRS Agents, Managers and Instructors we can match the program that is the right one for you.
The IRS can accept an offer in compromise based on these three grounds:
1. Doubt as to Collectibility . Doubt exists that the taxpayer could ever pay the full amount of tax liability owed within the remainder of the statutory period for collection.
This is the most common offer and it is known as the pennies on the dollar settlement. We will walk you through this program and make sure you are a good fit to settle your tax case with this federal tax relief program.
2. Doubt as to Liability – A legitimate doubt exists that the assessed tax liability is correct. Possible reasons to submit a doubt as to liability offer include:
1. the examiner made a mistake interpreting the law
2. the examiner failed to consider the taxpayer’s evidence or (3) the taxpayer has new evidence.
3. Effective Tax Administration – There is no doubt that the tax is correct and there is potential to collect the full amount of the tax owed, but an exceptional circumstance exists that would allow the IRS to consider an OIC. To be eligible for compromise on this basis, a taxpayer must demonstrate that the collection of the tax would create an economic hardship or would be unfair and inequitable. Beside these programs there is another program called the hardship program. If you are under a current hardship, call us today for immediate tax relief. Fresh Start Tax 1-866-700-1040 Same day levy releases. Fresh Start Tax can get you a same day levy release. We need to make sure all your tax returns are filed and need a completed 433-F with documentation.
An IRS Federal tax levy is a legal seizure of your property to satisfy a tax debt. Levies are different from tax liens. A tax lien is a claim used as security for the tax debt, while a levy actually takes the property to satisfy the tax debt. What can IRS Levy
1. The IRS could seize and sell property that you hold (such as your car, boat, or house.) This happens on a 668A form.
2. The IRS could levy the following property: your wages (668W,) retirement accounts, dividends, bank accounts, licenses, rental income, accounts receivables, the cash loan value of your life insurance or commissions. 3. The IRS can levy social security and disability. What does it take for the IRS to send a tax levy out to me?
1 . The IRS assessed the tax and sent you a Notice and Demand for Payment. This sometimes comes certified.
2. If you neglected or refused to pay the tax.
3. The IRS sent you a Final Notice of Intent to Levy and Notice of Your Right to A Hearing (levy notice) at least 30 days before the levy. The IRS may give you this notice in person, leave it at your home or your usual place of business, or send it to your last known address by certified or registered mail, return receipt requested. Please note: if they levy your state tax refund, you may receive a Notice of Levy on Your State Tax Refund, Notice of Your Right to Hearing after the levy. How can I get a release of the Federal Tax Levy
1. If you paid all you owed before the IRS sent the levy notice,
2. If the IRS assessed the tax and sent the levy notice when you were in bankruptcy, and subject to the automatic stay during bankruptcy,
3. The IRS made a procedural error in an assessment,
4. The time to collect the tax (called the statute of limitations) expired before the IRS sent the levy notice. This is 10 years from the date of the assessment,
5. You did not have an opportunity to dispute the assessed liability,
6. You wish to discuss the collection options. This is the best way for an immediate release. Call Fresh Start Tax and we can usually get these releases within one day.
7. You wish to make a spousal defense. When will my levy end?
If the IRS levies your wages, salary, or federal payments, the levy will end when:
1.The tax levy is released,
2. You pay your IRS tax debt, or
3. The time expires for legally collecting the tax. 10 years after the assessment date.
4. Have Fresh Start Tax call the IRS and get you a levy release.
If the IRS levies your bank account, your bank must hold funds you have on deposit, up to the amount you owe, for 21 days. This holding period allows time to resolve any issues about account ownership. After 21 days, the bank must send the money plus interest, if it applies, to the IRS. To discuss your case, call the IRS employee whose name is shown on the Notice of Levy. A wage garnishment is a continuous levy. It Never stops .
