As a former IRS Agent I visited many of the IRS Service Centers and different ACS Units. To say the least they are massive, full of people, full of computers and full of everyday people like you and me.

The Service Center I spent my time in, Atlanta Georgia, is some 7 1/2 acres. If the sign did not say “IRS”,  you would not know what was going on in the center.

 

So, what is the Automated Collection System, also known as ACS?

The ACS Unit is the first contact/correspondence from the IRS to the taxpayers on any given tax situation.

This IRS system has been established by the IRS  to collect outstanding tax liabilities. ACS is fully responsible for the issuance of the various notices and letters to taxpayers to remind them of the money that they owe to the IRS.

The system is famous for the issuance of bank and wage levies, filing of the federal tax liens as well as audit correspondence  notices.

When you think of Automated you may think of General Motors with cars going through plants with little assembly required.

The automated collection system is people driven. Think of these centers more like call centers or telemarketers.

Some of the centers are in Buffalo, Jacksonville, Seattle, Philadelphia, Denver and Oakland. They take calls up to 8:00 pm EST.

The Automated Collection System and its representatives manage most of the unpaid tax issues, and they resolve non-filer cases as well.

For those cases that cannot be resolved over the telephone or by mail, (there is no email correspondence from the IRS)  the ACS Unit will send the case out to local Revenue Officers in the different IRS field offices.

They are located in the area where you reside.

It is there that your case will be assigned. All of the cases I worked at the IRS with my 10 years at the Service were generated from the ACS  Unit.

The ACS  gets  first crack at the taxpayers and then its the job of the Revenue Officer to close the case file. They are the last resort and they always get the job done. When ACS transfers a case to the field office, it will no longer have control over that case.

Personnel at the ACS. The IRS representatives at the ASC Unit are trained up to a point. They are not technical IRS Agents. They have a basic meat and potatoes approach.

All canned with a process to follow. Some are friendly and some are not. You can tell how the interview will go just by the way they say hello.

On occasion I have hung up and started with a new agent because of the attitude right off the bat. You have to keep in mind that they are people who have a lot of power for their level of education and training.

When speaking to them, always secure their name and ID number.  Always be friendly.

We have issued a notice of levy to collect your unpaid employment taxes under Internal Revenue Code (IRC) Section 6331.

We have taken this action because we previously asked you to pay the federal tax shown on the next page, but the tax remains unpaid.

This letter is also your notification of your right to request Appeals consideration under IRC Section 6330(a).

We are permitted by law to levy to collect the tax listed on this notice without first giving you an opportunity for Appeals consideration.

A taxpayer is not entitled to a pre-levy hearing under IRC Section 6330 for an unpaid employment tax period occurring within 2 years after a previous employment tax period that was included in a request for hearing under IRC Section 6330. Our records show that you (or your predecessor) previously requested a hearing under IRC Section 6330 that included an employment tax period falling within the two-year period.

If you wish to appeal this levy action, complete the enclosed Form 12153, Request for a Collection Due Process or Equivalent Hearing, and send it to us within 30 days from the date of this letter.

To preserve your right to contest Appeals’ decision in the U.S. Tax Court, you must complete, sign, and return Form 12153 to the address shown above within 30 days from the date of this letter.

If the levy proceeds did not fully pay your taxes and you don’t pay the amount you owe, or make alternative arrangements to pay, we may take additional enforced collection action against your property, or rights to property, such as real estate, automobiles, business assets, bank accounts, and other income.

The IRS must meet the follow criteria before sending out a notice of federal tax levy.

These three requirements must be met:

1.  The IRS assessed the tax and sent you a Notice and Demand for Payment;
2 . The taxpayer  neglected or refused to pay the tax; and
3.  The IRS sent you a Final Notice of Intent to Levy and Notice of Your Right to A Hearing (levy notice) at least 30 days before the levy. They may give you this notice in person, leave it at your home or your usual place of business, or send it to your last known address by certified or registered mail, return receipt requested.
