If you are in bankruptcy, the IRS will not consider a filing of an offer in compromise.

The IRS Official Position:

The IRS will not consider an offer in compromise while a taxpayer is in bankruptcy.

When a taxpayer files bankruptcy, the Bankruptcy Code provides legal remedies and procedures to resolve the government’s claim.

If the taxpayer files bankruptcy while the case is being considered by Appeals, the offer must be closed.

In this instance, the offer has already been rejected (by Collection) and Appeals no longer has a basis to overturn Collection’s decision.
