Railroad Benefits, Medal of Honor Winners, and Annuities for Military Families and Survivors
Certain annuity and pension payments are exempt from levy. See IRC 6334.
The exempt payments include:
1. Railroad Retirement and Unemployment
2.Special Pensions for Medal of Honor Winners
3.Annuities under the Retired Serviceman’s Family Protection Plan and Survivor Benefit Plan
Although IRC Section 6331(h) permits the Service to levy on up to 15 percent of railroad retirement and railroad unemployment payments, the Service will not pursue these levy sources at this time.
