Despite what you hear on TV about every one being able to settle their tax debt for pennies on the dollar, there is a realization that all taxpayers can settle their tax debt. The airwaves, media outlets and social sites are putting in the minds of people who IRS is willing to settle these tax debts.

The information your hearing is the only truthful information that you need to know regarding relieving yourself of a federal or state tax obligation.

 

How IRS Will Deal With a Federal IRS Tax Debt

IRS has a very specific system to deal with federal tax debt.

Throughout the United States there must be a oneness and a fairness so all taxpayers are treated equally. With that said, many taxpayers who owe under $25,000 can simply go online and make a payment agreement as long as they meet all of the qualifications.

 

Filing All Tax Returns

One of the qualifications that hold most people up on settling your IRS tax debt is the fact that all federal tax returns have to be filed.

IRS will not close a case in their working inventory nor take you off of the IRS enforcement computer unless you are in full compliance with all filings. It is a must and IRS will not compromise on this issue.

For those of you who cannot enter an online payment program with the Internal Revenue Service, the IRS has a particular format in place to decide how they are going to deal with your federal tax debt.

IRS uses two/three forms to make those determinations.

Those cases at the service center will use form 433F, and those in the local office, mainly revenue officers will use the 433 a. If you have a business they will assist you fill out the 433B which is a business financial statement.

After the IRS receives these financial statements they will insist that all documentation accompanying the financial statements be presented to them as well.

They will ask for the last six months with the bank statements, verification of all expenses, pay stubs, and any other pertinent information to determine collectibility. Basically, IRS is conducting a mini audit on your financial statement to verify that you are truthful and accurate for them to make a correct decision.

IRS has also a format as to what expenses that they will allow because they cannot allow people to spend what they want and not pay federal taxes.

The IRS has a list of all allowable expenses and their boundaries that they will allow.

These boundaries have been set up by the Department of Labor and are used by the United States trustee in bankruptcy court so all federal agencies use the same guidelines and boundaries.

IRS will insist that you stay within the financial boundaries in:

1. housing and utilities,

2. food and clothing,

3. car payments, and,

4. insurance.

How Will IRS Proceed To Close Your Case

IRS after a careful review of your financial statement and documentation IRS will generally will conclude one of three closing methods.

Number one:

IRS may determine that you’re in a current hardship in place you into a non-collectible file.

The good news is you will not have to make payments or deal with IRS for a period of 1 to 3 years however penalties and interest will still run. IRS will bring the case back out to the field to review at a later time within a prescribed period of time.

IRS will place a refund freeze on your account so all refunds go to the Internal Revenue Service. If you fail to file another tax return on time or pay it in full your case will automatically be generated back to the field. If IRS does this are going to be a lot stricter in working your case

40% of all open cases and IRS collection inventory are placed in hardship.

Number two:

IRS may determine after a careful review of your income and expenses that you are a payment, installment or a monthly agreement candidate.

IRS will discuss with you after review of that statement exactly how much that payment will be and set up the terms of that agreement.

6.5 million taxpayers enter into monthly payment agreements, with one-third of all taxpayers default.

Number three:

After a review of your financial statement it could be determined that you are an offer in compromise or tax debt settlement candidate which means you can settle for pennies on the dollar.

The offer in compromise is not for everyone and we are very careful to proceed and filing your offer unless you’re a truly qualified candidate.

When I was employed by the Internal Revenue Service I work the offer in compromise program. there are three general programs to settle your tax debt, the offer in compromise, the payment agreement and the hardship program but before IRS accepts any of these programs you must have all your tax returns filed and up-to-date.

Due to social media, marketing and advertising the assumption by the general public is that IRS can settle tax debt for pennies on the dollar.

 

Let me first let you know that IRS does accept offers in compromise and as a matter of fact last year approximately 32,000 offers in compromise were accepted out of the 78,000 that were filed.

That number varies from year to year but the percentages usually remain the same of acceptability.

The average settlement was $9500 per case but remember that is just an average in not everybody can settle their tax debt for $9500.

There is much information you need to know before you go off filing an offer of compromise and giving your money to some firm to try to pull off some amazing trick because you have been sold a bill of goods and bought in to some marketing ploy and they’ve convinced you are a settlement candidate.

 

The IRS Process:

 

It first starts with the review of your personal financial statement which is found on the 433 OIC.

When the offer in compromise gets sent in to the Internal Revenue Service it is met with the reviewer that make sure that you are truly qualified candidate for the offer in compromise program.

That reviewer checks the completed form to make sure it is a valid agreement. The offer in compromise is a legal document between you and the Internal Revenue Service.

If IRS were to accept the offer and the next day you win the lottery the accepted offer still stands.

Also reviewer make sure that all the documentation is attached so that the revenue officer who will work your offer in compromise can move forward.

Approximately one-third of all offers in compromise are sent back to the taxpayer because the offers are not filled out correctly or the appropriate documentation is not attached.

IRS will check to make sure all your tax returns are current and filed on the IRS system.It is critically important you know that you must have all tax returns filed before IRS will process your offer.

You should know that the Internal Revenue Service rejects an offer before it accepts an offer. one of the basic rules is that the revenue officer is lazy and is easier to mark rejected then they go through all the work of accepting an offer in compromise.

I should know this is a former instructor of the offer in compromise I see many revenue officers simply send offers back because some of the eyes were not dotted in the T’s were not crossed.

Due to the volume of cases the IRS has, which is over 7500 cases waiting in the IRS Q, is far easier for the IRS to say no then to accept because an average of anywhere between 20 and 40 hours are spent on accepting the offer in compromise.

If you have an offer in compromise accepted, four signatures are generally required for signature as it goes up and down the chain.

The first place to go is to fill out the IRS pre-qualifier tool for the offer in compromise. Because of so many scrupulous tax companies that have been ripping people off, the IRS wanted to make sure the general public has a tool that they can use to find out if they are prequalified to file the offer in compromise to make sure it is a viable option.

It contains all the necessary information in regard to your income, your expenses and your assets and it predetermined for you whether the offer in compromise is even a viable option for you.

IRS on larger dollar cases is a tremendous amount of due diligence.

The IRS has a wealth of information on the various computers they can use to dig and find assets or income.

Why? you may ask is because all offers in compromise are open for public inspections at eight regional offices throughout the United States.

Your offer in compromise must be thoroughly documented which includes all your bank statements for the last six months to a year, all your pay stubs, all your monthly expenses along with certain documentation for assets that have value.

IRS also takes a look at the values of your pensions, your IRA, your business as well.

The offer in compromise is one of the most reviewed documents, it is like going through a mini audit.

 

Some of the due diligence that IRS will conduct on a larger dollar cases is checking Google, the accurate search engine, Department of Motor Vehicles, real estate records, insurance policies, credit reports, loan applications, insurance policies, and inter-government agency records including those garnered by Homeland security and other such agencies.

State Dept Can Revoke Passport On Back Taxes + Here is What to Do + Taxpayer Notification – Notice CP 508C

Since the federal government needs money a genius idea came up, lets  revoke passports on back taxes thus forcing international travelers to dig deep in their pockets to pay Uncle Sam.

 

When you think about it, the idea is not a bad one at all because most of the international travelers have some bucks in their pockets, so the government is hitting them where it hurts.

One of the things most American travelers never wants to happen is to have their passport revoked in the fear is driving many to pay their back taxes.

The IRS is using the State Department, homeland security and immigration to all get in the mix here to start to enforce the tax law.

Here is how the system in the process works.

Certification Of Individuals With Seriously Delinquent Tax Debt

Seriously delinquent tax debt is an individual’s unpaid, legally enforceable federal tax debt totaling more than $51,000 (including interest and penalties) for which a:

• Notice of federal tax lien has been filed and all administrative remedies under IRC § 6320 have lapsed or been exhausted or
• Levy has been issued

Seriously delinquent tax debt is limited to liabilities incurred under Title 26 of the United States Code and does not include debts collected by the IRS such as the FBAR Penalty and Child Support.

Some tax debt is not included in determining seriously delinquent tax debt even if it meets the above criteria. It includes tax debt:

• Being paid timely with an IRS-approved installment agreement
• Being paid timely with an offer in compromise accepted by the IRS, or a settlement agreement entered with the Justice Department
• For which a collection due process hearing is timely requested regarding a levy to collect the debt
• For which collection has been suspended because a request for innocent spouse relief under IRC § 6015 has been made

Additionally, a passport won’t be at risk under this program for any taxpayer:

• Who is in bankruptcy
• Who is identified by the IRS as a victim of tax-related identity theft
• Whose account the IRS has determined is currently not collectible due to hardship
• Who is located within a federally declared disaster area
• Who has a request pending with the IRS for an installment agreement
• Who has a pending offer in compromise with the IRS
• Who has an IRS accepted adjustment that will satisfy the debt in full

Certification will be postponed while an individual is serving in a designated combat zone or participating in a contingency operation.

Before denying a passport, the State Department will hold your application for 90 days to allow you to:

• Resolve any erroneous certification issues
• Make full payment of the tax debt
• Enter a satisfactory payment arrangement with the IRS

Annual Adjustment For Inflation

The $51,000 threshold is indexed yearly for inflation
Under new Code Section 7345(f), in the case of a calendar year beginning after 2016, the dollar amount in new Code Section 7345 shall be increased by an amount equal to (1) such dollar amount, multiplied by (2) the cost-of-living adjustment determined under Code Section 1(f)(3) for the calendar year, determined by substituting “calendar year 2015” for “calendar year 1992” in Code Section 1(f)(3)(B).

If any amount as adjusted under the preceding sentence is not a multiple of $1,000, such amount shall be rounded to the nearest multiple of $1,000.

Taxpayer Notification – Notice CP 508C

The IRS is required to notify you in writing at the time the IRS certifies seriously delinquent tax debt to the State Department. The IRS is also required to notify you in writing at the time it reverses certification. The IRS will send written notice by regular mail to your last known address.
Note: Your Power of attorney (POA) will not receive a copy of your CP508C.

Reversal Of Certification – Notice CP 508R

The IRS will reverse a certification when:

• The tax debt is fully satisfied or becomes legally unenforceable.
• The tax debt is no longer seriously delinquent.
• The certification is erroneous.

The IRS will make this reversal within 30 days and provide notification to the State Department as soon as practicable.

A previously certified debt is no longer seriously delinquent when:

• You and the IRS enter into an installment agreement allowing you to pay the debt over time.
• The IRS accepts an offer in compromise to satisfy the debt.
• The Justice Department enters into a settlement agreement to satisfy the debt.
• Collection is suspended because you request innocent spouse relief under IRC § 6015.
• You make a timely request for a collection due process hearing regarding a levy to collect the debt.

The IRS will not reverse certification where a taxpayer requests a collection due process hearing or innocent spouse relief on a debt that is not the basis of the certification. Also, the IRS will not reverse the certification because the taxpayer pays the debt below $50,000.

Judicial Review Of Certification

The State Department is held harmless in these matters and cannot be sued for any erroneous notification or failed decertification under IRC § 7345.

If the IRS certified your debt to the State Department, you can file suit in the U.S. Tax Court or a U.S. District Court to have the court determine whether the certification is erroneous or the IRS failed to reverse the certification when it was required to do so. If the court determines the certification is erroneous or should be reversed, it can order the IRS to notify the State Department that the certification was in error.

IRC § 7345 does not provide the court authority to release a lien or levy or award money damages in a suit to determine whether a certification is erroneous. You are not required to file an administrative claim or otherwise contact the IRS to resolve the erroneous certification issue before filing suit in the U.S. Tax Court or a U.S. District Court.

Payment Of Taxes

If you can’t pay the full amount you owe, you can make alternative payment arrangements such as an installment agreement or an offer in compromise to have your certification reversed.

If you disagree with the tax amount or the certification was made in error, you should contact the phone number listed on Notice CP 508C: 1-866- 519-4965 (International callers: 1-267-941-1004). If you’ve already paid the tax debt, please send proof of that payment to the address on the Notice CP 508C.

If you recently filed your tax return for the current year and expect a refund, the IRS will apply the refund to the debt and if the refund is sufficient to satisfy your seriously delinquent tax debt, the account is considered fully paid.

Passport Status

If your U.S. passport application is denied or your U.S. passport is revoked, the State Department will notify you in writing.

If you need your U.S. passport to keep your job, once your seriously delinquent tax debt is certified, you must fully pay the balance, or make an alternative payment arrangement to have your certification reversed.

Once you’ve resolved your tax problem with the IRS, the IRS will reverse the certification within 30 days of resolution of the issue and provide notification to the State Department as soon as practicable.

Travel

If you’re leaving in a few days for international travel, need to resolve passport issues and have a pending application for a U.S. passport, you should call the phone number listed on Notice CP 508C – If you already have a U.S. passport, you can use your passport until you’re notified by the State Department that it has been revoked.

If your passport is cancelled or revoked, after you’re certified, you must resolve the tax debt by paying the debt in full, making alternative payment arrangements or showing that the certification is erroneous.

The IRS will reverse your certification within 30 days of the date the tax debt is resolved and provide notification to the State Department as soon as practicable.
