What do I have to do to qualify for this program?

First of all you must have a legitimate hardship. If you do, simply call our office and we will start working to see if you fit the IRS test to place you in a Hardship Status.

 

How long has this program been around?

This program has always been around but it is not spoken of very much because IRS wants to collect the money, so this program is not advertised.

 

How do I know if I qualify and when could I find out?

The IRS has an acid test for this program and it is called the National Standards Program. If you meet the means test, your case may be put in a Noncollectable Status.
Fresh Start Tax can advise you if you meet the means test.

 

How long will my case stay in the Noncollectable Status?

Your case stays there for at least one year, most times for three years. Depending on your tax returns, your case could stay there for the life of the statue.

 

What forms are necessary to complete the National Standard Test?

Form 433A or 433F Information Collection Statements are the IRS forms needed to complete this test. Once the form is complete, IRS will ask for the documentation to make sure you are telling the truth. If you are and you qualify, your case will be put in Noncollectable Status.

What are other situations that qualify for Hardship Status?

  • The taxpayer has a terminal illness or excessive medical bills;
  • The taxpayer is incarcerated;
  • The taxpayer’s only source of income is social security, welfare, or unemployment;
  • The taxpayer is unemployed with no source of income.

Each situation is based on its own set of circumstances and truth of the matter is that old adage, no two cases are the same.

 

What will the IRS do to examine my case?

  • IRS will require a 433 Information Collection Statement with corresponding documentation;
  • IRS will will search and verify the value of your assets through DMV and County Courthouse records;
  • IRS will use the National Standards Test to your qualify expenses.
