<li> Taxpayers should use IRS  Form 12277, Application for Withdrawal, (PDF form available ). In item 8, Reason for requesting withdrawal, check box hat is applicable to your case.</li>
</ul>
<p>Eligibility requirements are as follows:</p>
<p>1. Your tax liability has been satisfied and your lien has been released<br />
2. You are in compliance for the past three years in filing:<br />
3. All individual and business returns have been filed<br />
4. All information returns have been filed<br />
5. You are current on your estimated tax payments and federal tax deposits, as applicable.</p>
<p>Federal Tax Lien withdrawal may also occur when after entering into a Direct Debit installment agreement.</p>
<p>If you are a qualifying taxpayer and meet the eligibility requirements, you may have your lien withdrawn after entering into a Direct Debit installment agreement.</p>
<p>Your request for lien withdrawal must be in writing. Please use Form 12277, Application for Withdrawal (PDF). In item 8, “Reason for requesting withdrawal,” check box b, the “entered into an installment agreement” provision.</p>

<li>Your Direct Debit Installment Agreement must full pay the amount you owe within 60 months or before the Collection Statute expires, whichever is earlier</li>
<li>You must be in full compliance with other filing and payment requirements</li>
<li>You must have made three consecutive direct debit payments</li>
<li>You cannot have previously received a lien withdrawal for the same taxes unless the withdrawal was for an improper filing of the lien</li>
<li>You cannot have defaulted on your current, or any previous, direct debit installment agreement.</li>
</ul>

<p>The Offer in Compromise  cases are just sitting in piles being unattended to because of the large volume of cases that the IRS has received.</p>
<p>The combined impact of a weak economy and efforts by the Internal Revenue Service (IRS) to promote the Offer in Compromise (OIC) Program has increased the number of requested offers by 28 percent between Fiscal Year 2007 and FY 2011.</p>
<p>At the very same time sadly, the IRS  resources available to work the <a href="http://www.freshstarttax.com/offer-in-compromise.php" title="Offers In Compromise">offers in compromise</a> have decreased, creating a huge inventory.</p>
<p>These are the findings of a report publicly released  by the <span style="color: #ff0000;">Treasury Inspector General for Tax Administration (TIGTA).</span></p>
<p>An tax settlement program called the Offer in Compromise (OIC) is an agreement between a taxpayer and the IRS to settle a tax liability for payment of less than the full amount owed.</p>
<p>TIGTA&#8217;s audit was initiated to assess the effectiveness of the OIC Program to timely process requests, consistently apply OIC guidelines, accurately measure Program results, and effectively promote the Program.</p>
<p>TIGTA reviewed a statistically valid sample of offers and found that the IRS did not process all offers timely.</p>
<p>In 73 (74 percent) of 99 offers, the IRS failed to contact the taxpayer by the promised date. The report estimates that 9,509 taxpayers who submitted offers between July 1 and December 31, 2010, may not have been contacted when promised. A promised date, will never happen.</p>
<p>Additionally, as of October 25, 2011, <span style="color: #ff0000;">there were 7,472 unassigned offers in holding</span> ( WOW )queues awaiting assignment to OIC staff.</p>
<p><span style="color: #ff0000;">TIGTA found that one processing site had more than four times as many unassigned offers from self-employed taxpayers compared with the other site, and 37 percent of those offers were more than six months old.</span></p>
<p>TIGTA auditors also determined that an incorrect date was used when offers were returned to the IRS because of some IRS processing errors. The report estimates that the wrong date may have been used for 712 taxpayers who submitted offers between July 1, 2010, and December 31, 2010. Finally, the IRS does not have formal performance measures for the streamlined offer process, which allows IRS employees to make taxpayer contact by telephone rather than by mail so they can quickly make a determination on an OIC request.<br />
TIGTA recommended that the IRS revise OIC processing procedures, train employees, and add a formal performance measure for the streamlined offers or apply the streamlined process to all offers.</p>
<p>IRS officials agreed with TIGTA&#8217;s recommendations and the report&#8217;s outcome measures and plan to take appropriate corrective actions. Specifically, the IRS plans to:</p>
<p>1) try to better inform taxpayers by lengthening the time by which they will be contacted or issued an interim letter,</p>
<p>2) initiate reassignment of offers between IRS sites as needed, and</p>
<p>3) apply most aspects of the streamlined process to the remainder of the OIC cases.</p>

<p>A <a href="http://www.freshstarttax.com/irs-bank-levy/" title="Wage Levy">Wage Levy</a> or Wage Garnishment has a different feature. After a business receives a levy the wages are immediately frozen and the employer must send the applicable proceeds to the IRS on the next scheduled pay period. There is no grace period.  As a general rule the taxpayer can keep around 10% that is exempt from the levy. IRS will send out a form that details the exact exempt amount.</p>
<p>IRS does not wish to levy. The hope is that the taxpayers call the IRS to work out or make a tax settlement to resolve the tax problem or tax situation.</p>
<p>Tax Levies can usually be released within one week sometimes even that day if we can get records from the taxpayer.</p>
<p>A <a href="http://www.freshstarttax.com/tax-liens/" title="IRS Tax Lien">Federal Tax Lien</a> is a notice filed at the Public Courthouse in the area of your residence putting the public and creditors on notice you owe IRS taxes. It is not a seizure just a notice.</p>
<p>Anyone has access to public records and everyone can has access to your tax information.</p>
<p>Your credit score will be badly damaged as a result of a Federal <a href="http://www.freshstarttax.com/tax-liens/" title="Tax Lien">Tax Lien</a>. A Federal <a href="http://www.freshstarttax.com/tax-liens/" title="Tax Lien">Tax Lien</a> cannot be removed until it is paid in full or the statute of limitations runs. When it comes to filing your tax return, however, the law provides that the IRS can assess a penalty if you fail to file, fail to pay or both.</p>
<p>The two different penalties you may face are the failure to file and the failure to pay.These are two of the larger penalties.</p>
<p>1. If you do not file by the deadline, you might face a failure-to-file penalty.This is a maximum of 25% if the return is 5 months late. It is critical even of you do not have the money to file a timely tax return.</p>
<p>2. The penalty for filing late is usually 5 percent of the unpaid taxes for each month or part of a month that a return is late. This penalty will not exceed 25 percent of your unpaid taxes.</p>

<p>4. If you do not pay your taxes by the due date, you will generally have to pay a failure-to-pay penalty of ½ of 1 percent of your unpaid taxes for each month or part of a month after the due date that the taxes are not paid. This penalty can be as much as 25 percent of your unpaid taxes.</p>
<p>5. If you request an extension of time to file by the tax deadline and you paid at least 90 percent of your actual tax liability by the original due date, you will not face a failure-to-pay penalty if the remaining balance is paid by the extended due date.</p>
<p>6. If both the failure-to-file penalty and the failure-to-pay penalty apply in any month, the 5 percent failure-to-file penalty is reduced by the failure-to-pay penalty. However, if you file your return more than 60 days after the due date or extended due date, the minimum penalty is the smaller of $135 or 100 percent of the unpaid tax.</p>
<p>7. You will not have to pay a failure-to-file or failure-to-pay penalty if you can show that you failed to file or pay on time because of reasonable cause and not because of willful neglect.</p>

			<content:encoded><![CDATA[<h4>If you have received a IRS Letter or Tax Notice here is what you need to know concerning the correspondence you have received from the Internal Revenue Service.</h4>

<h4>5. If you do not agree with the correction the IRS made, it is important to respond as requested. You should send a written explanation of why you disagree and include any documents and information you want the IRS to consider along with the bottom tear-off portion of the notice.You should mail the information to the IRS address shown in the upper left of the notice. Allow at least 30- 45 days for  the IRS to response.</h4>
<h4>6. Most correspondence can be handled without calling or visiting an IRS office. However, if you have questions, call the telephone number in the upper right of the notice. Have a copy of your tax return and the correspondence available when you call to help the IRS respond to your inquiry.</h4>
<h4>7. It is important to keep copies of any correspondence with your records. You cannot email any information to the IRS.</h4>
